MONKEY'S 'SELFIE' COPYRIGHT REJECTED

People in Asia are celebrating the Year of the Monkey, but in the U.S., a judge has handed down some unhappy news to one primate. He issued a legal opinion stating that a monkey cannot hold a copyright.
In 2011, a British photographer set up a camera on the Indonesian island of Sulawesi, but it was a macaque that tripped the shutter. The resulting photograph was published by the photographer.
Last year, a U.S.-based animal rights group filed a lawsuit on behalf of the macaque, which the group calls "Naruto." The group wants Naruto to be declared owner of the copyright and receive damages for infringement. The photographer claims that he owns the copyright because he set up the camera and the tripod.
The issue has generated considerable interest in the U.S. The animal rights group is considering its legal options.

“自撮り”のサルに著作権なし

アジアの人々はさる年のお祝いをしていますが、アメリカでは裁判所がサルにとって残念な判決を言い渡しました。裁判官は、サルには著作権がないとする法的見解を示したのです。
２０１１年にイギリス人の写真家がインドネシアのスラウェシ島でカメラを設置しましたが、（自分に向けて）シャッターを切ったのはマカク属のサルでした。撮られた写真は、このイギリス人写真家の名義で発表されました。去年、アメリカの動物愛護団体が、「ナルト」と名付けたこのサルの代理で訴えを起こしました。訴えは、写真の著作権者がナルトであることの確認と、著作権侵害の賠償を求めたものです。これに対して写真家は、カメラと三脚を設置したのは自分で、自分に著作権があると主張しました。
この問題はアメリカで大きな注目を集め、訴えを起こした動物愛護団体は、ほかに有効な法的手だてがないかどうかを探っています。
